Terms of Service

These terms govern your use of the FAKER mobile app. Effective September 21, 2026.

Welcome to FAKER (the “App”), a mobile party game published by MasaiCode (“we,” “us,” or “our”). These Terms of Service (“Terms”) are a legal agreement between you and MasaiCode and govern your download, installation, and use of the App on iOS, iPadOS, and Android devices. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may only use the App under the supervision of a parent or legal guardian who agrees to these Terms. By using the App, you represent that you meet these requirements.

2. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App for your own non-commercial entertainment on any mobile device that you own or control, as permitted by the usage rules of the app store from which you obtained it (the App Store or Google Play).

You agree that you will not, and will not permit anyone else to:

  • copy, modify, or create derivative works of the App except as expressly allowed by these Terms;
  • reverse engineer, decompile, or disassemble the App, or attempt to derive its source code, except where such restriction is prohibited by law;
  • rent, lease, lend, sell, sublicense, or otherwise distribute the App;
  • remove or alter any proprietary notices, or circumvent any security or access controls in the App.

3. App store terms

Your download and use of the App is also subject to the terms and policies of the app store you obtained it from. In the event of a conflict between these Terms and an app store's terms, the app store's terms will govern solely with respect to your acquisition and use of the App through that store.

Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and MasaiCode only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, or expenses attributable to a failure to conform to a warranty are our responsibility. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

Google Play

If you downloaded the App from Google Play, your use is also governed by the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

4. Purchases and subscriptions

The App is free to download and play. We also offer an optional premium upgrade (“FAKER Pro”) and other in-app purchases that unlock additional features such as premium word categories, custom word packs, and online multiplayer.

  • Billing. All purchases are processed by the applicable app store (Apple or Google) using the payment method on your store account. We do not collect or store your payment card details.
  • Auto-renewing subscriptions. If you buy a subscription, it automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
  • Managing and cancelling. You can manage or cancel a subscription any time in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
  • Refunds. Purchases are handled by the app stores, and refunds are subject to their policies. We generally cannot issue refunds directly; please contact the relevant app store.
  • Price changes. We may change prices for purchases and subscriptions. Where required, we will notify you and, for subscriptions, any change applies to renewals after notice.

5. User-generated content

The App lets you create custom content, such as your own word packs and player names (“User Content”). You retain ownership of your User Content. You are solely responsible for it and represent that you have the rights to submit it and that it does not violate any law or third-party right.

You agree not to create User Content that is unlawful, infringing, hateful, harassing, defamatory, obscene, or otherwise objectionable. Custom packs you create are stored on your device; if you use an optional feature that transmits content to our services (for example, AI word suggestions or online multiplayer), you grant us a limited licence to process that content solely to provide the feature.

6. Acceptable use

You agree not to use the App to:

  • break any applicable law or regulation;
  • interfere with, disrupt, or attempt to gain unauthorised access to the App or its related systems;
  • harass, abuse, or harm other players in online features; or
  • use automated means to access the App in a way that burdens our infrastructure.

7. Intellectual property

The App and all associated content, design, graphics, word packs, logos, and the FAKER name are owned by MasaiCode or its licensors and are protected by intellectual property laws. Except for the licence granted above, these Terms do not transfer any rights in the App to you.

8. Third-party services

The App uses third-party services to operate, including analytics, crash reporting, purchase processing, and (for optional online features) backend infrastructure. Your use of those features is also subject to the relevant third parties' terms. We are not responsible for third-party services.

9. Disclaimers

The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, MasaiCode and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or USD $50.

11. Termination

These Terms apply until terminated. Your rights under these Terms end automatically if you fail to comply with them. We may suspend or terminate your access to the App or its online features at any time if you violate these Terms. You may stop using the App at any time by deleting it from your device.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective” date above and, where appropriate, provide additional notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws applicable at the principal place of business of MasaiCode, without regard to conflict of laws principles, and subject to any mandatory consumer protection laws of your country of residence.
